»Legitimation of Mixed Financing in the Financial Constitution of the Basic Law. On the Problem of Art. 104c and 104d GG«: The insertion of Art. 104c and 104d GG into the Basic Law in 2017 and 2019 has led to a significant expansion of co-financing of tasks of the Federal States (»Länder«) by the Federation (»Bund«). With municipal education infrastructure and social housing, core areas of »Länder« sovereignty are affected. The paper analyses the resulting (democratic) problems and comes to a proposal on how a strict limitation of federal aid to special emergencies could be implemented.
